Welcome to Onda Recovery. These Terms of Service (the "Terms") govern your access to and use of the website ondarecovery.com (the "Site"). These Terms cover your use of the Site itself. Purchases made through the Site are governed by our Terms of Sale, together with our Shipping Policy and Refund Policy, all available on the Site.
## 1. Acceptance of these Terms
By browsing the Site, creating an account, placing an order or otherwise using any part of the Site, you confirm that you have read, understood and agreed to these Terms. If you do not agree with any part of them, please do not use the Site.
## 2. Eligibility
The Site is intended for users who are at least 18 years old. If you are under 18, you may only use the Site with the involvement and consent of a parent or legal guardian. By placing an order, you confirm that you meet this requirement and that the information you provide is accurate and complete.
## 3. Product information
We take genuine care to describe our products accurately. That said:
- Product photos and videos are for illustration. Colours, proportions and finish may appear slightly different on your screen or in different lighting.
- Despite our best efforts, an obvious error may occasionally appear in a price or description (for example, a clearly incorrect price caused by a typing or technical mistake). Where such an obvious error affects an order, we may correct it or cancel the affected order before dispatch. If your order is cancelled for this reason, you will be notified by email and any amount already paid will be refunded in full.
Nothing in this section limits your rights under the Australian Consumer Law, including the guarantee that goods match their description.
## 4. Site availability
We work to keep the Site online and running smoothly, but we cannot promise uninterrupted or error-free access. The Site may be temporarily unavailable due to maintenance, updates or technical issues beyond our control. We may modify, suspend or discontinue any part of the Site at any time. Where reasonably possible, we will give notice of planned interruptions, but we are not obliged to do so.
## 5. Intellectual property
All content on the Site — including text, product descriptions, photographs, videos, graphics, logos, page layouts and the Onda Recovery name and branding — belongs to us or to our licensors and is protected by intellectual property laws.
You may browse the Site and print or save extracts for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify or commercially exploit any Site content without our prior written permission.
## 6. Reviews and customer content
We welcome honest reviews and other content you choose to share with us (such as photos or comments). By submitting content, you:
- grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and display that content in connection with the Site and our marketing, with or without your name or handle;
- confirm the content is your own, reflects your genuine experience and does not infringe anyone else's rights;
- accept that we may moderate, decline to publish or remove content that is unlawful, offensive, misleading, irrelevant or submitted in bad faith.
We do not publish fabricated reviews, do not edit reviews to change their meaning, and do not offer incentives in exchange for positive reviews.

The Site may contain links to third-party websites or services (for example, payment providers or carrier tracking pages). These are provided for convenience only. We do not control third-party sites and are not responsible for their content, policies or practices. Your use of any third-party site is at your own discretion and subject to that site's own terms.
## 8. Prohibited uses
When using the Site, you agree not to:
- break any applicable law or regulation, or encourage anyone else to;
- attempt to gain unauthorised access to the Site, its servers or any connected systems;
- introduce viruses, malware or any other harmful code;
- scrape, harvest or collect data from the Site by automated means without our written permission;
- place fraudulent orders, use stolen payment details or impersonate another person;
- interfere with the Site's operation or with another user's enjoyment of it;
- use the Site or its content to build or promote a competing offering.
We may suspend or block access to the Site, and cancel related orders, where we reasonably believe these rules have been breached.
## 9. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded — including your rights under the Australian Consumer Law and any equivalent mandatory protections in your place of residence.
Subject to the above, and to the maximum extent permitted by law:
- the Site and its content are provided "as is" and "as available";
- we are not liable for loss or damage arising from your use of, or inability to use, the Site where that loss was not reasonably foreseeable or was outside our control (for example, internet outages or third-party service failures);
- we are not liable for indirect or consequential loss, such as loss of profits, data or opportunity, arising from use of the Site.
Nothing in this section affects your rights in relation to products you purchase, which are addressed in our Terms of Sale.
## 10. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
## 11. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in our practices or in the law. The version in force is always the one published on this page, with its "Last updated" date. Changes apply from publication and do not affect orders already placed. We encourage you to review this page periodically.
## 12. Governing law
These Terms are governed by French law, as INCM is a company incorporated in France. However, if you are a consumer residing in Australia, you always keep the benefit of the mandatory consumer protections of Australian law — including the Australian Consumer Law — and nothing in these Terms takes those protections away from you. In plain terms: French law applies as a baseline, but your non-negotiable rights as an Australian consumer remain fully intact.
