# Terms of Sale

These Terms of Sale apply to every purchase made on ondarecovery.com (the "Site"). The Site is operated by INCM, a company incorporated under French law (SIREN 939 062 899, SIRET 939 062 899 00017), with its registered office at [ADRESSE COMPLÈTE DE DOMICILIATION — Les Tricolores, Pontoise (95), France — À COMPLÉTER PAR L'UTILISATEUR] ("Onda Recovery", "we", "us" or "our").
By placing an order, you accept these Terms of Sale, together with our Shipping Policy and Refund Policy, which form part of the contract between us. Please read them before ordering.
## 1. Scope
These Terms of Sale govern sales of products by Onda Recovery to consumers located in Australia, made through the Site. They apply to personal (non-business) purchases. The Site is presented in English and all prices are in Australian dollars (AUD).
## 2. Prices
- All prices on the Site are displayed in Australian dollars (AUD) and include all applicable taxes and fees. The price you see at checkout is the price you pay — there are no hidden charges.
- Shipping is free on all orders, anywhere in Australia.
- We may change our prices at any time, but changes never apply retroactively: the price charged is always the price displayed at the moment you placed your order.
- If an obviously incorrect price appears on the Site due to a typing or technical error, we may cancel the affected order before dispatch and refund you in full, as described in section 3.
## 3. Ordering
Placing an order works as follows:
1. Add the product to your cart and proceed to checkout.
2. Enter your delivery details and review your order summary (product, price, delivery address).
3. Choose your payment method and confirm payment.
4. You will receive an order confirmation by email. The contract between us is formed when we send this confirmation.
We may decline or cancel an order before dispatch in limited cases: where we reasonably suspect fraud or unauthorised use of a payment method, where an obvious pricing or description error affects the order, or where we are unable to verify the order details. If your order is declined or cancelled, we will notify you by email and refund any amount already paid in full.
Please check your delivery details carefully — we are not responsible for delays caused by an incorrect address provided at checkout, though we will always do our best to help put things right.
## 4. Payment
- We accept payment via Shopify Payments and PayPal, covering Visa, Mastercard, American Express, Apple Pay and Shop Pay.
- Your payment method is charged when you place your order.
- All transactions are processed through secure, encrypted payment providers. Your card details never pass through or get stored on our servers.
## 5. Delivery
Full details are set out in our Shipping Policy. In summary:
- Shipping is free across Australia.
- Orders are prepared and dispatched within 3–5 business days.
- Delivery takes 6–10 business days after dispatch — most orders arrive within 9–15 business days in total.
- You will receive a tracking number by email once your order ships.
- Orders ship directly from our partner distribution centres.
If your parcel has not arrived within 15 business days of dispatch, contact us at ondarecovery@gmail.com and we will arrange a replacement or a full refund.
## 6. Transfer of risk
The products remain at our risk until they are delivered to the address you provided at checkout. Risk in the products passes to you upon delivery.
## 7. Returns and refunds
Our full process is set out in our Refund Policy. In summary:
- You have 30 days from the date you receive your order to change your mind, under our satisfaction guarantee.
- Items must be unused, clean and in their original packaging, with proof of purchase.
- Email us first at ondarecovery@gmail.com with your order number — we will confirm the return address and instructions. Please do not send anything back without instructions.
- Return shipping is at your cost (tracked postage recommended), except where the product is faulty, not as described or we made an error — in that case the return is free and you can choose a full refund or a replacement.
- Refunds are issued to your original payment method within 10 business days of us receiving and inspecting the return.
## 8. Your guarantees
### Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
These consumer guarantees apply automatically, free of charge, and nothing in these Terms of Sale limits or replaces them.
### Our 30-day satisfaction guarantee
In addition to — and without limiting — your rights under the Australian Consumer Law, we offer a voluntary 30-day satisfaction guarantee on every order, as described in section 7 and in our Refund Policy. This commercial guarantee is provided by INCM (contact details above and below) and gives you benefits beyond your statutory rights; it never reduces them.
## 9. Liability
Nothing in these Terms of Sale excludes, restricts or modifies the consumer guarantees under the Australian Consumer Law or any other right or remedy that cannot lawfully be excluded.
Subject to that, and to the maximum extent permitted by law, our total liability in connection with an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss (such as loss of profits or opportunity) arising from a purchase.
## 10. Customer service and complaints
If anything about your order isn't right, tell us — we genuinely want to fix it.

We handle every complaint individually and aim to resolve it directly with you as quickly as possible.
## 11. Governing law and disputes
These Terms of Sale are governed by French law, as INCM is a company incorporated in France. However, if you are a consumer residing in Australia, you always keep the benefit of the mandatory consumer protections of Australian law — including the Australian Consumer Law — and nothing in these Terms of Sale takes those protections away from you.
If a dispute arises, please contact us first at ondarecovery@gmail.com: in our experience, almost everything can be resolved amicably and quickly. If we cannot reach a solution together, you remain free to pursue any remedy available to you under applicable law, including through the courts or consumer protection bodies competent for your place of residence.
